Tempered Minds' Mission

Tempered Minds' mission is to provide world-class martial arts sword training for practitioners of all skill levels.

We strive to ensure that the training is accessible to people of all ages and from all walks of life, so that whether you're a master martial artist with decades of experience or you've never even touched a sword before, you are guaranteed to come away with new information, unique insights, and best of all... new friends.

Seminar Goals

  • Recruit top-talent for seminar instructors from around the world
  • Deliver hands-on training that prepares students for their next rank
  • Present new/novel approaches to training aspects
  • Grow the national and international martial arts community through sword training and camaraderie

Sponsorship Benefits

  • Gain visibility with local Pittsburgh-area attendees and visitors who travel from other states and countries to attend.
  • Stay visible beyond the seminar: your ad appears in the 8.5"x11" printed seminar booklet - not a one-time handout, but a lasting training reference participants keep and refer to.
  • Your name and artwork will appear on the event's registration page and you will be recognized in seminar communications.
  • Directly support event production costs - venue, booklets, and more

Sponsorship Registration

Terms of Agreement

Sponsor and Organizer Terms of Agreement

This Sponsor and Organizer Terms of Agreement (“Agreement”) is made between Tempered Minds LLC, Eric R. Jenko, and their assistants, volunteers, and agents (collectively, the “ORGANIZER”) and the sponsoring organization, business, or individual completing the applicable sponsorship registration or submission (the “SPONSOR”). This Agreement is effective upon the SPONSOR’s submission of the sponsorship form or registration, together with the SPONSOR’s required acknowledgment of these terms, and remains in effect through the end of the applicable event.

Sponsorship Agreement

This Agreement governs the sponsorship relationship between the ORGANIZER and the SPONSOR for the applicable event. The specific sponsorship level, benefits, deliverables, and related details selected or confirmed by the SPONSOR shall be governed by the applicable sponsorship package, registration page, written confirmation, or other event materials provided by the ORGANIZER.

Sponsor Marketing Use Agreement

During the term of this Agreement, the SPONSOR may identify itself in its marketing materials as an official sponsor of the applicable event, provided such use is accurate, not misleading, and does not imply any broader endorsement, partnership, or continuing affiliation beyond the sponsored event.

Production Timeline

In order for the ORGANIZER to fulfill promotional benefits for the SPONSOR, the SPONSOR agrees to meet all applicable submission deadlines established by the ORGANIZER. Required materials may include, without limitation, logos, website URLs, advertisement files, promotional copy, and display materials. Deadlines will not be extended to accept late materials, and the ORGANIZER shall not be responsible for any missed benefit resulting from the SPONSOR’s failure to timely provide required materials.

Sponsor Trademark Usage Agreement

The SPONSOR agrees to allow the ORGANIZER to use the SPONSOR’s name, trademark, logo, tagline, and related branding materials solely as necessary for the ORGANIZER to perform and fulfill its obligations under the applicable sponsorship package and this Agreement.

Sponsor Trademark Usage

Notwithstanding the section above, the SPONSOR agrees that the ORGANIZER may use the SPONSOR’s name, trademark, logo, tagline, and related graphics in connection with the event and the fulfillment of sponsorship benefits, including but not limited to the following:
- Event web pages and related online materials.
- Sponsor benefit items described in the applicable sponsorship package or event materials.
- Event-related materials such as banners, signs, programs, handouts, slides, booklets, lanyards, apparel, or similar materials.

Web Reference

The SPONSOR may publish an Internet hyperlink from the SPONSOR’s website or online materials to the event website or related event pages and may maintain such hyperlink through the duration of the event and thereafter unless removal is requested by the ORGANIZER.

Payment

Sponsorship is not confirmed until the ORGANIZER has received full payment and accepted the SPONSOR’s submission. Failure to provide full payment may result in cancellation of the requested sponsorship.

Vendor Responsibility

The ORGANIZER is an event organizer and not a supplier of other goods or services to the SPONSOR. It is the SPONSOR’s responsibility to complete any internal procurement, approval, vendor onboarding, tax, payment-processing, or other administrative requirements necessary for the SPONSOR’s participation.

Refunds

The ORGANIZER will not provide refunds after event-specific promotional or printed materials have been committed to production.

Non-Endorsement

The use of the SPONSOR’s name or branding in connection with the event, the event website, or related event materials does not constitute endorsement of the SPONSOR or the SPONSOR’s products, services, or programs by the ORGANIZER. The SPONSOR shall not represent, directly or indirectly, that the ORGANIZER has endorsed the SPONSOR or any of the SPONSOR’s products, services, or programs.

Non-Exclusivity

The ORGANIZER does not award exclusive sponsorships or establish exclusive relationships with SPONSORS unless expressly stated in writing. The SPONSOR shall not imply that any exclusive or preferential relationship exists between the SPONSOR and the ORGANIZER.

Code of Conduct

Tempered Minds events are organized to bring people together to train, learn, share, and build community through martial arts. A fundamental requirement for achieving this goal is a respectful environment. Insults, harassment, intimidation, and conduct that targets an individual in a manner that makes them feel unwelcome are not acceptable. Harassment does not include discussing differing viewpoints in a civil and respectful manner.

Participants who are asked to stop unacceptable behavior are expected to comply immediately. The ORGANIZER reserves the right to respond to misconduct in the manner it deems appropriate, including removal from the event without refund and referral to venue management or relevant authorities when appropriate.

This Code of Conduct applies to all persons participating in the event, including attendees, instructors, speakers, staff, volunteers, sponsors, sponsor representatives, and guests.

If the SPONSOR or any representative of the SPONSOR experiences or witnesses behavior that conflicts with this Code of Conduct, the SPONSOR should notify the ORGANIZER, event staff, or venue staff as soon as possible. Reports will be handled as discreetly and sensitively as reasonably possible.

Attendee Contact Information

The ORGANIZER will not provide attendee contact information to the SPONSOR unless the ORGANIZER expressly states otherwise in writing.

Speaking, Demonstration, and Training Opportunities

Any speaker, instructor, demonstration, workshop, seminar, or related program opportunities are filled through the ORGANIZER’s selection process and event planning process. Sponsorship does not entitle the SPONSOR to any automatic speaking, teaching, demonstration, or training opportunity unless expressly stated in writing by the ORGANIZER.

Sale of Merchandise

The SPONSOR must obtain and satisfy all necessary licenses, permits, certificates, approvals, and tax requirements in order to sell merchandise or other goods at the event. If merchandise or goods are to be sold, the SPONSOR must provide proof of any applicable licenses, permits, certificates, or approvals to the ORGANIZER prior to the event upon request.

Limited Liability

If circumstances beyond the commercially reasonable control of the ORGANIZER interfere with or prevent, in whole or in part, the ORGANIZER’s fulfillment of the SPONSOR’s promotional benefits under this Agreement, the SPONSOR agrees that the ORGANIZER, and each of their respective owners, officers, employees, volunteers, agents, insurers, and affiliates, shall not be liable to the SPONSOR for any legal, financial, or consequential damages arising from such circumstances beyond the amount of the sponsorship fee paid by the SPONSOR.

Force Majeure

Neither the ORGANIZER nor the SPONSOR shall be deemed in default of this Agreement to the extent performance of its obligations, or attempts to cure any breach, are delayed or prevented by an act of God, fire, natural disaster, accident, epidemic, pandemic, act of government, labor dispute, venue closure, interruption of utilities or transportation, or any other cause beyond that party’s commercially reasonable control.

If an event is cancelled due to uncontrollable circumstances, the ORGANIZER may work with SPONSORS in good faith to return any unspent sponsorship funds on a prorated basis where appropriate and feasible.

Rejection

The ORGANIZER reserves the right to reject any sponsorship submission for any reason, in its sole discretion. If the ORGANIZER rejects a sponsorship submission after payment has been received, the ORGANIZER will issue a full refund of the amount paid for that sponsorship.

Entire Agreement

This Agreement, together with any applicable sponsorship package, registration page, written confirmation, or related attachments expressly incorporated by reference, constitutes the entire agreement between the ORGANIZER and the SPONSOR regarding the subject matter of the sponsorship.

By submitting a sponsorship application, registration, or payment and affirmatively agreeing to these Terms, the SPONSOR commits to and agrees to be bound by this Agreement.
